These Gym Gear Pilot terms of use (“Terms”) govern your access to and use of gymgearpilot.com and any pages, content, tools, or features that link to these Terms (collectively, the “Site”).
The Site is operated under the Gym Gear Pilot name (“Gym Gear Pilot,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and acknowledge the policies incorporated by reference. If you do not agree, do not use the Site.
Gym Gear Pilot publishes independent gym equipment reviews, comparisons, buying guides, and practical fitness information for a primarily U.S. audience. We do not sell the products featured in our content, process retailer payments, provide medical care, or act as your personal trainer.
Use Gym Gear Pilot as a general research resource. Product specifications, prices, availability, safety instructions, and individual fitness needs can change. Confirm important information with the manufacturer, retailer, and an appropriately qualified professional before purchasing equipment or beginning an exercise program.
1. Acceptance of These Terms
Your use of the Site forms an agreement between you and the Site operator concerning that use. These terms and conditions also incorporate the Privacy Policy, Cookie Policy, Affiliate Disclosure, Editorial Policy, Medical Disclaimer, and any additional rules displayed for a particular feature. If feature-specific terms conflict with these Terms, the feature-specific terms control for that feature.

Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have an injury, medical condition, symptoms, are pregnant, take medication, or have concerns about whether an activity is appropriate. Stop exercising and seek appropriate assistance if you experience pain, dizziness, chest discomfort, shortness of breath beyond normal exertion, or other concerning symptoms. 9. Limited License to Use the Site
Subject to these Terms, Gym Gear Pilot grants you a limited, personal, nonexclusive, nontransferable, revocable license to access and use the Site for lawful, noncommercial research and reading. You may print or save reasonable portions for personal use if you keep applicable notices and do not misrepresent the source. No other right or license is granted.

You represent that you have the necessary rights, that your submission is accurate to the best of your knowledge, and that it does not violate these Terms or another person’s rights. Do not submit confidential information, sensitive personal information, medical records, payment information, or content you do not have permission to share.
You grant Gym Gear Pilot a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, publish, and distribute User Content as reasonably necessary to operate, moderate, promote, and improve the Site. This license does not transfer ownership of your User Content. We may refuse, edit, move, or remove submissions, but we are not obligated to monitor all User Content.
12. Feedback
If you voluntarily provide an idea, correction, suggestion, or other feedback about the Site, you permit us to use it without restriction or compensation, provided that this does not override rights that cannot lawfully be waived. We may credit a correction or contribution at our discretion, but no attribution is promised unless agreed in writing.
13. Copyright Concerns
We respect intellectual-property rights. If you believe material on the Site infringes your copyright, send a detailed notice through the Contact page identifying the copyrighted work, the material and its exact Site location, your contact information, a good-faith statement, a statement of accuracy and authority made under penalty of perjury, and your physical or electronic signature. 15. Assumption of Risk and Personal Responsibility

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GYM GEAR PILOT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT ANY PRODUCT, PROGRAM, OR INFORMATION WILL PRODUCE A PARTICULAR RESULT.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted, and you may have rights that vary by location.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYM GEAR PILOT AND ITS OWNERS, CONTRIBUTORS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THIRD-PARTY PRODUCTS OR YOUR FAILURE TO FOLLOW SAFETY INSTRUCTIONS; OR DAMAGES ARISING FROM ACCESS TO, USE OF, OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, total liability for claims arising from the Site will not exceed the greater of the amount you paid directly to Gym Gear Pilot to use the Site during the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US $100). This limitation does not apply where prohibited or to liability that cannot legally be limited.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gym Gear Pilot and its owners, contributors, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Site, your User Content, or your material violation of these Terms or another person’s rights. This obligation does not require you to indemnify a party for conduct that cannot legally be indemnified.
19. Suspension and Termination
We may suspend, restrict, or terminate access to all or part of the Site if we reasonably believe you violated these Terms, created security or legal risk, or interfered with the Site or others. We may also discontinue a feature or the Site. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, liability, indemnification, and dispute provisions—will survive.
20. Governing Law and Disputes
These Terms are governed by the laws applicable to the Site operator, without regard to conflict-of-laws principles, except where mandatory consumer law requires otherwise. Before filing a formal claim, you agree to send a written description through the Contact page and allow a reasonable opportunity to seek an informal resolution. Nothing in these Terms prevents either party from seeking urgent relief for misuse of intellectual property, security threats, or other harm where such relief is legally available.
Any court proceeding must be brought in a court with lawful jurisdiction over the parties and dispute. These Terms do not require arbitration and do not waive a right to participate in a class action unless a separately posted, legally reviewed agreement expressly states otherwise.
21. General Terms
- Severability. If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue.
- No waiver. A failure to enforce a provision is not a waiver of that provision or any other right.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a business reorganization, transfer, or by operation of law, subject to applicable requirements.
- Entire agreement. These Terms and incorporated policies form the entire agreement concerning use of the Site, except for a separate written agreement that expressly controls.
- Electronic communications. You agree that notices and records may be provided electronically where permitted by law.
- Headings. Headings are for convenience and do not limit interpretation.
